Is there a difference in the 2018 and 2019 specs? My Daytona is 14 plate, built late 2013, but spec is same so it doesn't matter to me. Plenty of vehicles are older than the plate might suggest. If there is no difference in the 18 and 19 specs what's the worry?
If you do a charge back they can’t then take the payment again unless you make the payment again. Or if they are really dodgy, they could without your permission, use card details they’ve stored. Which would be in breach of PCI standards so couldn’t land them in hot water
So, I've emailed Via-Moto over a week ago and not had a reply. So I'm now going to write to them before contacting trading standards. Here's what I'm going to say. Anyone have any comments? "Dear Sir/Madam, The Trade Descriptions Act 1968 says that it is an offence for a trader to give a false or misleading description of the goods and services they are supplying. Under this Act I am requesting a full refund (£249) which I placed on Saturday 4th July 2020 on the Aprillia Tuono motorcycle - Registration Y019 FNU which was advertised as a 2019 model on eBay and on Autotrader when actually the bike is a 2018 model. When placing the deposit I was not told that the bike was a 2018 model, neither was I told my deposit was not refundable. I trust you will agree I am due a full refund but if the matter is not resolved in a timely manner I will be forced to contact Trading Standards. Yours Sincerely,..."
Looks good but really you don’t have to even state a reason. - If you’ve placed a deposit on a vehicle at a distance, either online or over the phone, you are entitled to cancel your order within 14 days and receive a full refund of your deposit, regardless of your reasons or any money the retailer has spent. - Bear in mind though, that if you placed a deposit at the retailer’s premises, you may not be able to receive a full refund, and you’ll need to check the terms and conditions that you signed. - If you’ve paid for a vehicle in full, and taken delivery of it, you have 14 days to change your mind from when you receive the vehicle – again, you don’t have to give a reason for cancelling and the retailer must give you a full refund. - If the retailer doesn’t give you information about your rights under a distance sale at the time of delivery, including your right to cancel the purchase within 14 days, then you’ll have up to 12 months to cancel your order and receive a refund.
Maybe you should actually commit to buying a bike instead of wasting everybody's time. Dealers must hate seeing you walk through the door...
Yes youre totally right and I do hate myself for it. I will be black listed by all dealers eventually. I’m getting very indecisive in my old age. I’m confident I’m not the only one though
They're the ones repeatedly accepting your deposit/deposits.....they don't hate you walking through the door THAT much.
Well, I've emailed Via Moto and written to them too but heard nothing. Guess it's time to get Trading Standards involved?
Might be worth contacting your bank as they are on a serious drive to crack down on things like this. Good luck
Literally, just checked my bank account after posting the above and the money has been refunded to my bank account. Not heard anything from Via Moto themselves though...
To reply would involve them acknowledging their misconduct. So fwiw I'm not surprised that they've opted to simply refund you. Pleased that you've got this sorted.
